Obour’s appointment as Ghana Post MD is in breach of Parliamentary Acts – Kobina Bedu

A Procurement expert, Kobina Atta Bedu says President Akufo-Addo’s appointment of Bice Osei Kuffour as acting Managing Director of the Ghana Post Company Limited is in contravention of the Act 505 of the 1992 constitution.

According to Atta Bedu, the Ghana Postal Services Corporation 1995 (Act 505) makes absolutely no provision for the position of acting Managing Director, thus one cannot be appointed to serve in a constitutionally unrecognised position.

He further stated that Bice Osei Kuffour popularly known as Obour, who is expected to start functioning in that capacity does not remotely qualify for the position.

He said, “This appointment should be subject to the Public Services Commission. PSC appointments are via a rigorous interview process.

“I am waiting to see how the Commission will conduct interviews and recommend the appointment of a candidate who’s profile below does not suggest any legal competence and experience in the running of any commercial entity of the size and stature of Ghana Post (circa 800 FTEs).”

Kobina Bedu points out in Section 9 of Act 505 that the absence of a governing Board – a requirement for the appointment of the Director-General – technically makes it tricky for the appointment of Obour as the Managing Director.

It is stated in Section 9 (2) of Act 505 that “The Director-General shall be appointed by the President in accordance with the advice of the Board given in consultation with the Public Services Commission and shall hold office on such terms and conditions as shall be specified in his letters of appointment. “

In (3) of the same section it states that “The Director-General shall subject to the directions of the Board on matters of policy be responsible for the direction of the business, administration and organization of Ghana Post.”

He argues that “Since there has been no functioning Board for the last 12 months and there’s no indication of any Board appointment, how long is the candidate or the substantive Deputy DG supposed to hold the forth given that he will be unable to function effectively without a controlling mind.”
